My friend was sitting on a bench smoking week when a cop came up to him. But here is the thing...the cop was not in uniform but he told my buddy to stop smoking and hand over the Marijuana right away. Since the guy was not in uniform my friend said "let me see your badge"
the cop took this as resisting arrest or something and felt the need to break my friend's nose.

Any form of legal action that can be taken?
